1. Acceptance of Terms

By accessing or using the Viajamas platform, website, mobile applications, or any other services offered by Viajamas, Inc. (collectively, the "Service") at viajamas.co, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service. If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Viajamas, Inc. ("Viajamas", "we", "us", or "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and references to "you" include both you individually and the organization.

2. Description of Service

Viajamas is a travel planning platform that allows users to build detailed itineraries, store and organize travel documents, track travel budgets, collaborate with travel companions, receive packing recommendations, and access a centralized hub for all aspects of trip planning. The Service is provided by Viajamas, Inc., Av. Javier Prado Este 4200, Lima 15023, Peru.

We may add, modify, or remove features of the Service at any time. We will endeavor to provide reasonable notice of significant changes that materially affect the core functionality you rely on. Continued use of the Service after any changes constitutes your acceptance of the revised Service.

3. Account Registration and Security

You must create an account to access most features of the Service. When registering, you agree to provide accurate, current, and complete information. You must update your account information promptly if it changes.

You are responsible for maintaining the confidentiality of your account credentials (username and password). You agree to notify us immediately at security@viajamas.co if you suspect unauthorized access to your account. You are responsible for all activity that occurs under your account credentials, whether or not authorized by you.

You may not share your account credentials with others, create accounts for third parties without their consent, or create multiple accounts for the purpose of circumventing account restrictions. Accounts are for individual use unless you have entered into a separate agreement with us for team or business access.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. By creating an account, you represent and warrant that you meet this minimum age requirement.

4. Subscription Plans and Payment

Viajamas offers both free and paid subscription plans. The features available on each plan are described on our pricing page. We reserve the right to change plan pricing or features with reasonable advance notice.

Paid subscriptions are billed in advance on a monthly or annual basis, as selected at the time of purchase. All fees are non-refundable except as expressly stated in these Terms or required by applicable law. If you cancel a paid subscription, you will retain access to paid features until the end of your current billing period.

We use third-party payment processors to handle all financial transactions. By providing payment information, you authorize us to charge the applicable fees to your payment method. If a payment fails, we may suspend your access to paid features until payment is resolved. You are responsible for any taxes applicable to your use of the Service.

We may offer promotional pricing, free trials, or discounts from time to time. Any such offers are subject to the specific terms stated at the time of the offer and may be discontinued at any time.

5. User Conduct and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to:

(a) Violate any applicable local, state, national, or international law or regulation;
(b) Transmit or upload any content that is unlawful, harmful, defamatory, obscene, fraudulent, or otherwise objectionable;
(c) Upload, transmit, or distribute malicious software, viruses, or any code designed to interrupt, damage, or limit the functionality of any computer software or hardware;
(d) Attempt to gain unauthorized access to any part of our systems, accounts belonging to other users, or any network connected to our servers;
(e) Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent;
(f) Interfere with or disrupt the integrity or performance of the Service or any servers or networks connected to the Service;
(g) Use the platform for commercial travel agency services, bulk booking management for third parties, or any purpose that competes with Viajamas without our prior written consent;
(h) Reverse engineer, decompile, or disassemble any software components of the Service;
(i) Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including suspending or terminating accounts and reporting to law enforcement authorities.

6. Your Content and Data

You retain full ownership of all content, data, and information you upload, create, or store in the Service ("User Content"), including your itineraries, travel documents, photos, notes, and personal information. These Terms do not transfer any intellectual property rights in your User Content to Viajamas.

By uploading or storing User Content, you grant Viajamas a limited, non-exclusive, worldwide, royalty-free license to store, process, reproduce, and display your User Content solely to the extent necessary to provide, maintain, and improve the Service and as otherwise described in our Privacy Policy. This license terminates when you delete your User Content or your account.

You are solely responsible for your User Content. You represent and warrant that you have all rights necessary to grant us the license described above, and that your User Content does not violate any third-party rights or applicable law. You acknowledge that we may remove any User Content that we reasonably believe violates these Terms, applicable law, or the rights of any third party.

We do not use your travel itineraries, documents, or personal trip data to train machine learning models, for advertising purposes, or for any purpose other than providing the Service as described in our Privacy Policy.

7. Intellectual Property Rights

The Viajamas platform, including its design, software, algorithms, features, user interface elements, documentation, and all content created by Viajamas (excluding User Content), is owned by Viajamas, Inc. and is protected by copyright, trademark, patent, and other intellectual property laws.

Subject to your compliance with these Terms, Viajamas grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial travel planning purposes. This license does not include the right to: copy, modify, or create derivative works of the Service; distribute, transmit, or sell any part of the Service; decompile or reverse engineer any part of the Service; or remove any copyright or proprietary notices from the Service.

The Viajamas name, logo, and product names are trademarks of Viajamas, Inc. You may not use these marks without our prior written permission.

8. Third-Party Services and Integrations

The Service may integrate with or provide links to third-party services such as airline booking platforms, hotel reservation systems, map services, calendar applications, and other travel-related tools. These integrations are provided for your convenience.

Viajamas does not control third-party services and is not responsible for their availability, accuracy, content, pricing, terms of service, or privacy practices. Any transactions you conduct with third parties through such integrations are solely between you and the third party. We encourage you to review the terms and privacy policies of any third-party services you use in connection with Viajamas.

We may add, modify, or remove third-party integrations at any time. The availability of a particular integration does not constitute an endorsement of the third-party service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIAJAMAS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VIAJAMAS DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (C) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

Travel planning involves inherent uncertainty. Viajamas does not guarantee the accuracy of travel information, pricing, availability, or scheduling data obtained through the platform. Always verify critical travel details directly with airlines, hotels, and other travel providers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIAJAMAS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF VIAJAMAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID VIAJAMAS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Viajamas and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Service in violation of any applicable law; or (d) your violation of any third-party right, including intellectual property rights or privacy rights.

12. Termination

You may terminate your account and these Terms at any time by deleting your account through Settings > Account > Delete Account or by contacting us at hello@viajamas.co. Termination takes effect upon account deletion, which is processed within 30 days.

Viajamas may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms. If we terminate your account without cause, we will provide a pro-rated refund of any prepaid subscription fees for the unused portion of your billing period.

Upon termination: your right to access and use the Service ceases immediately; we will handle your data as described in our Privacy Policy; provisions that by their nature should survive termination (including ownership provisions, warranty disclaimers, indemnification, and limitations of liability) shall survive.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall first be subject to informal resolution. You agree to contact us at legal@viajamas.co to attempt to resolve any dispute informally before initiating formal proceedings. We will attempt to resolve the dispute within 30 days of receiving written notice.

If informal resolution fails, disputes shall be resolved by binding arbitration administered by JAMS in Miami, Florida, under its then-current rules. The arbitration shall be conducted by one arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. You waive any right to a jury trial or class action proceeding.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in the courts of Miami-Dade County, Florida, to prevent irreparable harm. For users located in jurisdictions that do not permit mandatory arbitration, disputes shall be resolved in the courts of Miami-Dade County, Florida.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our business, legal requirements, or the Service. We will notify you of material changes by posting the new Terms on our website and sending an email to the address associated with your account at least 30 days before the changes take effect. Non-material changes may be made without notice.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, please discontinue use of the Service and delete your account before the effective date.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Viajamas regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Viajamas may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
